PROTECT

One of our clients’ primary concerns when putting together an estate plan is how they can protect their estate from unnecessary legal fees, family disagreements, unneeded taxes and incorrect or contested asset distributions.  What we find out is that the majority of our clients want to Protect their assets through the distribution process.  When clients try and do this, they actually increase their exposure to legal issues, a liability claim or contestability of their estate through no fault of their own.  When they place their children’s names on their assets or checking accounts, it actually co-mingles their assets with their entire extended family.  They didn’t know their estate could become exposed to a child’s divorce, bankruptcy, liability judgement, a grandchild’s mistake or unforeseen health event.  The death of an adult child could and often does place everything they worked so hard for at risk.  At MN Estate Services we take the time to educate our clients on the ‘best-practices-approach’ that soundly Protects our clients’ assets during their lifetime, in their passing and through the distributions to the family.  What have you done to Protect your estate?  Have you discussed it with a professional who has helped families through this process?

PRESERVE

What do we mean by preserve and what are you trying to preserve?  In this context, it specifically relates to your family’s legacy, land assets and financial value to your heirs.  What are your goals and objectives for your estate?  Are you trying to preserve assets for the next generation, such as land assets?  If this is one of the objectives of your estate, it all starts with having the proper estate plan.  Do you have a plan to preserve your estate?  An effective plan starts with an organized approach to get your estate in order that we help you navigate.  We give our clients a FREE Estate Planner to keep you organized and allows your family a place to find all your important information.

PASS ON

Pass On refers to your passing away.  If you have done any planning you will have one of two documents:  Last Will and Testament or a Revocable Living Trust.  If you do nothing to plan for this day by having a Last Will and Testament or setting up a Trust, you have made the ultimate decision to die ‘intestate’.  This is where a judge will decide for you what your Last Will and Testament will be.  A stranger to you and your family will now decide everything regarding your estate and asset distributions according to state law.  This process could incur excessive Probate Court fees, attorney fees, public record notifications and allows your assets to be publicly listed.  This process can cost anywhere from 2-7% of your gross estate in fees.  All assets will be “frozen” for a period of time until the court releases them.  Your family may have to wait many months or possibly longer to settle your estate.
